Today the Law «On dissolution of the Council of Deputies of De-Kastri Village in Ulchsky municipal district of Khabarovsk Krai» has been adopted at an extraordinary meeting of regional parliament. This gives occasion for regional election commission to call new De-Kastri Village Council of Deputies elections which might be held already this December, as reported by RIAP «Khabarovsk online».
The draft regional Law «On dissolution of Council of Deputies» was submitted to the legislative Duma by region Governor. It had been drafted in accordance with Article 73 of the Federal Law No. 131 «On general principals of organizing the local self-government within Russian Federation», which provides for liability of representative body of municipal formation to the government. One of such responsibilities is regular (at least once every three months) competent meeting of representative body that was not being respected in the case as confirmed by Ulchsky District Court decision of 8 June 2012.
Recall that local executive powers under the leadership of De-Kastri Administration Head were not able to exercise their authority adequately on legal grounds without official decisions of Council since meetings were not being held due to the absence of a quorum. Therefore such a large population center on the coast of Tatar Strait is to be satisfied with 1/12 of 2011 budget expenditures since budget for 2012 is not still approved. It is federal legislation requirement of a kind. This, in particular, jeopardizes timely preparations for the heating season within De-Kastri Village.
During an extraordinary meeting the Law «On modification of the regional budget for 2012» has been also adopted on final reading.
